General Terms and Conditions

The rights and obligations of Fekete Gergely e.v. (hereinafter referred to as the "Service Provider") and the Customer (hereinafter referred to as the "Customer") who utilize the electronic commerce services provided by the Service Provider through the website manova.com (hereinafter referred to as the "Website") are outlined in these General Terms and Conditions (hereinafter referred to as the "GTC") in accordance with Section 2(a) of Act CVIII of 2001 (hereinafter referred to as "Elkertv").

The Service Provider's Website is designed to facilitate the commercial sale of the products that are accessible on the site.

These GTC are applicable to all contracts and services that are entered into between the Service Provider and the Customer (hereinafter collectively referred to as the "Parties") through the aforementioned Website, irrespective of whether the performance is conducted by the Service Provider or its subcontractor in Hungary or abroad. By accepting these GTC, the Customer declares that the contract is concluded for purposes related to their profession, independent occupation, or business activity, and is not considered a consumer under Section 8:1 (1) point 3 of Act V of 2013 on the Civil Code (hereinafter referred to as "Ptk") or Section 2(a) of Act CLV of 1997 on Consumer Protection (hereinafter referred to as "Fgytv") if the Customer acts on behalf of a legal entity or as a sole entrepreneur during the transaction. The Consumer Protection Information and Withdrawal Statement Template, which is a component of these GTC, is used by the Service Provider to provide information on the rights and obligations of consumers that arise from the transaction if the Customer qualifies as a consumer under the Ptk. and the Fgytv.

The Website's services are available to all Customers of the Service Provider who have successfully registered on the Website and have acknowledged the provisions of these GTC as binding.

2. OVERVIEW

2.1. The Service Provider's products may be acquired by submitting electronic order requests in accordance with the terms of these GTC.

2.2. The Customer submits their offer to purchase the selected product by completing all required fields of the relevant product form, verifying the entered data, and selecting the "Order" button.

3. OBLIGATIONS OF THE SERVICE PROVIDER

3.1. The Service Provider is required to deliver the goods, transfer ownership of the goods, and, if necessary, provide all related documents in accordance with these GTC. The Service Provider's registered address is the place of performance, unless the Parties have otherwise agreed or the GTC specify otherwise.

3.2. The Service Provider is obligated to forward the products to the Customer or arrange for their delivery in accordance with the "Shipping Method" selected by the Customer during the order process if the "Shipping Address" field is provided during the order. The shipping costs are the responsibility of the Customer, as specified on the Website. PayPal, bank transfer, and credit card payment are the payment methods that are available for the products receiving as specified in this clause.

3.3. The Service Provider is obligated to deliver the products in accordance with the contractual requirements regarding storage and packaging, as well as the quantity, quality, and description specified in the contract.

3.4. The Service Provider is obligated to provide the product in accordance with the branding details specified by the Customer and accepted by the Service Provider if the Customer requests a "custom branding quote" during the order process and the contract is subsequently concluded through the offer and acceptance process. The Customer acknowledges that the product that has been created is a custom product, manufactured at their explicit request, and is subsequently classified as a product under Section 29(1)(c) of Government Decree 45/2014 (II.26.).

4. PAYMENT AND DELIVERY TERMS

4.1. The Service Provider will deliver the ordered product to the address specified by the Customer within the timeframe specified in the order confirmation email.

4.2. The Service Provider is required to deliver the ordered products within the shipping time specified in the confirmation email. The shipping period commences on the day following the complete payment of the purchase price. Delivery is executed through courier services or, in exceptional circumstances, the Service Provider's own transportation. The Service Provider is unable to assure delivery at a specific hour unless the Parties have explicitly agreed to it in writing.

4.3. The Service Provider may suspend service until the payment is resolved and may offset the amount of a new order against the previous debt if a Customer has an overdue unpaid invoice. The Customer is obligated to pay late interest as specified in the Ptk from the date of default. The Customer is responsible for all expenses associated with debt collection.

4.4. The Customer is required to inspect the package upon delivery and sign the delivery receipt to indicate entire acceptance. After this date, complaints regarding missing goods will not be entertained. The courier is required to conduct a comprehensive transition and document a report on-site at the Customer's request if the Customer observes any damage or discrepancies. The courier is accountable for any damages that occur during the transportation process.

4.5. The Customer is obligated to pay for their order immediately upon its placement. The Service Provider retains the right to adjust the shipping fees, which are effective immediately upon their publication on the Website. The modification does not affect orders that have already been submitted.

4.6. The delivery terms specified in this section are applicable to orders that are submitted in person, by phone, or via email.

5. OBLIGATIONS TO CUSTOMERS

5.1. In accordance with the terms of these GTC, the Customer is required to pay the purchase price and approve the goods.

5.2. The payment obligation encompasses the execution of the payment in accordance with the contract, relevant laws, and, in particular, the Ptk. and Elkertv. regulations, by taking all necessary steps. The Customer is required to finalize the payment prior to the Service Provider releasing the products to them, unless otherwise specified.

5.3. The Customer is required to pay the purchase price regardless of whether the products have been inspected. The payment terms of regular customers who have an established business relationship with the Service Provider may be subject to a separate agreement.

5.4. The Customer is required to avoid any action that could potentially mislead consumers, particularly in relation to the nature and characteristics of the products being sold. The Customer is exclusively accountable for adhering to legal obligations regarding the product's advertising, recommendation, distribution, and sale. The Service Provider reserves the right to pursue damages from the Customer for any losses that may have been incurred and disclaims all liability for violations.
